What Is Child Support?
Child support is the financial contribution made by one or both parents towards the cost of raising their children following separation. In Australia, Child Support Payments are designed to ensure children receive appropriate financial support from both parents.
How Is Child Support Assessed?
In most circumstances, child support in Australia is administered by Services Australia Child Support.
A Child Support Assessment is calculated using a formula that considers factors such as income, care arrangements, the number and ages of the children, and each parent’s necessary living expenses.
Once assessed, payments are typically administered through Services Australia, although sometimes payments are deducted from a person’s salary.
When a Child Support Assessment Is Not Fair
In some cases, a standard assessment may not accurately reflect a parent’s true financial circumstances.
When this happens, parents may apply for a Change Of Assessment Child Support through the Child Support Agency. This may happen where special circumstances exist, such as where there are significant costs associated with spending time with a child, where the costs of raising the child or children are higher due to an agreement that the parents previously made regarding how they would be raised (for example where both parents want the child to attend private school) or where the payer has significant medical expenses or where income does not reflect actual earning capacity.
In more complex matters, applications may be made to the Court for a Departure Order. A Departure Order is an order of the court that ‘departs’ from the child support assessment made by the child support agency.
Child Support Agreements
In many cases, parents will reach an agreement between themselves about what child support is to be paid and what this child support will cover. Some parents may choose to formalise arrangements through private agreements, providing greater certainty and flexibility.
Limited Child Support Agreements
A Limited Child Support Agreement allows parents to agree on payments that are equal to or greater than the assessed child support amount for a period of no longer than three years.. These agreements are often suitable for shorter-term arrangements, for example, where a child may be finishing school or transitioning from primary to secondary school. Limited Child Support Agreements can be entered into without independent legal advice. Before entering into such an agreement, the parties must complete an administrative assessment.
Binding Child Support Agreements
A Binding Child Support Agreement can last until such time as children finish their secondary education or turn 18. Each parent must receive independent legal advice prior to the Binding Child Support Agreement coming into effect. These agreements provide certainty regarding future expenses and liabilities for both parents/and can set payments above or below the assessed amount. You must complete an administrative child support assessment before you can enter into a Binding Child Support Agreement. All Child Support Agreements should be registered with Services Australia. Where an agreement is breached, it can be enforced through the court.

Child support arrangements may need to change if circumstances shift over time. This may include changes in income, care arrangements, or the addition of dependents.
